Resolving land issues is a rather complex and labor-intensive process, accompanied by the preparation of a large number of permits and taking a lot of time. Such issues are regulated by the Law of Ukraine “On Land Management”.
In what cases is a land allocation project necessary?
The need to develop a land allocation project is provided for by the norms of current legislation. As a rule, such a project is needed when:
- it is necessary to register the ownership of a plot;
- establish the boundaries of a land plot;
- change the intended purpose of the land.
It is worth noting that before starting to develop a land allocation project, it is necessary to obtain a special permit for the development of such a project from local government bodies.
Who and how can develop a land allocation project?
A land management project is developed by authorized individuals or legal entities that have a license to carry out such work. The project is developed after the conclusion of an agreement on the provision of development services, taking into account the assignment drawn up by the customer. The main documents required to develop a land allocation project:
- application for the development of the project;
- special permit for the development of a land allocation project;
- a copy of the passport and identification code for individuals, and for legal entities a copy of an extract from the registration documents and a copy of the title documents;
- a copy of the document approving the plan of the land plot and outlining its boundaries.
It is important to know that in each case additional documents may be required, the need to submit which will be informed to you by the person developing the project. The finished project is subject to mandatory approval by government agencies, such as land authorities, architectural services, environmental authorities, sanitary and epidemiological services, the urban planning authority and others. After the approval, the project must be registered in the state land cadastre. After such registration, the object receives a cadastral number and an extract from the cadastre, which describes the main characteristics of the site. It is quite difficult to understand all the intricacies of drawing up and registering land projects; without special knowledge, you can make a large number of mistakes, incorrectly draw up the necessary documents and thus significantly delay the process of obtaining permission, developing and coordinating a land allocation project.
