Modern legislation is constantly changing and improving for the comfort and safety of Ukrainian citizens. Today, the procedure for obtaining a permit for the construction of private residential buildings, gardens and summer cottages has been significantly simplified. The Law of Ukraine “On the Regulation of Urban Development Activity” provides for the possibility of such construction based on a construction passport. The Nobilex Law law firm provides its legal support and assistance in obtaining such a document.
What is a construction passport and who needs it?
A construction passport is a document that defines a set of architectural and urban planning requirements for the construction and placement of houses with an area of up to 500 m2, and no more than 2 floors. This also applies to outbuildings, structures, garages, landscaping elements, landscaping and engineering protection.
With a construction passport at your disposal, you can build almost anything you want on your land. This eliminates any problems with the law. Also, the presence of this certificate allows the developer to automatically begin construction simultaneously with the submission of a message to the State Inspectorate of Architecture and Urban Planning of Ukraine.
In addition to residential buildings, a construction passport must be issued for the following buildings:
- Sheds;
- Garages;
- Outbuildings.
The possibility of obtaining a construction passport will significantly simplify the procedure for obtaining a permit to build a house, since with a passport, a project is not required. It is also worth paying attention to the intended purpose of the land on which the construction is planned, it can be intended for:
- Homestead farming;
- Country house construction;
- Gardening.
Documents required to obtain a passport
A construction passport is issued by the local department of the state architectural organization after reviewing the submitted package of documents. To obtain a construction passport, you must provide the following documents:
- Application for a construction passport;
- passport and identification code;
- title documents for the land plot on which construction is planned;
- sketch plan of the building with a detailed indication of the location of the house, its dimensions, and the exact distance to neighboring plots and buildings, with a list and location of utility networks and structures;
- construction project (if any, but its submission is not mandatory);
- notarized consent of the co-owners of the site to carry out construction work, if any.
They review the application for a passport within 10 working days, after which you either receive a passport or a refusal to receive a construction passport. A decision to refuse may be made if an incomplete package of documents was submitted or if the documents do not meet the requirements of building codes.
Although at first glance the procedure for obtaining a construction passport seems simple, however, in the process of preparing documents, questions, misunderstandings and various unforeseen situations may arise, which may entail various legal consequences and lead to the resolution of disputes in court. Therefore, without special knowledge in this matter, without the help of a competent specialist, it is impossible to understand.
